Terms of Service

Effective 2026-09-30

These terms cover the free scan on this site and the work we do for clients. They are written to be read. If anything is unclear, email [email protected] and we will explain it before you buy anything.

1. Who we are

NightshiftDirect provides local search services for businesses: website scans, audits and fixes, Google Business Profile management, review requests, content, AI search work, websites, hosting and chatbots. We are not a law firm, and nothing we deliver is legal, medical or financial advice.

2. The free scan

Scan only websites you own or have permission to test. Our crawler identifies itself and follows robots.txt, and each connection is limited to 5 scans an hour and 20 a day. Scan results, including every dollar figure, are estimates made from public pages, the numbers you enter and the assumptions on our method page. They are not measurements, and they are not a promise of results.

3. How the work gets done

Our automated system, NightshiftDirect Scan and Research, does most of the drafting and technical work. Nothing changes on your website, your Business Profile or your ad accounts without your approval. Our How we work page explains what is automated and what you approve.

4. Starting work

Plans with a checkout button on our prices page can be bought directly at checkout. Buying a plan at checkout is your approval of that plan as published on this site, at the price shown, under these terms. Everything else, including Additional location, AI Search add-on, Website build, Hosting and care and AI chatbot, starts through the request form: we send you a written scope and price, and work starts only when you approve it in writing. If we cannot accept a checkout order, for example because another client already holds your business category in your metro area under our territory promise, we cancel it and refund your payment in full.

5. Prices and billing

Our prices are published on this site. Monthly plans are billed in advance and renew each month until you cancel. One-time services are billed at checkout, or when you approve a written scope. Payments are processed by Stripe; we never see your full card number. For monthly plans, you can update your card, see past invoices and cancel in Stripe's billing portal, reached from our billing page at /billing/. We give active clients at least 30 days' notice of a price change, and never change a price partway through a paid month.

6. Cancelling

Plans run month to month. Cancel any time: cancellation takes effect at the end of the month you have paid for, with no fee and no notice period. Our refund policy covers everything else about money back.

7. Delivery guarantee

If a monthly deliverable in your plan is not delivered by the date we give you, that month's fee is refunded in full. It does not apply while we are waiting on access, content or an approval from you.

8. What you own

Your accounts stay in your name. Pages, posts and other work we produce for you are yours once paid for. When you cancel, we send you a handover file listing the access you gave us, what we changed and anything still open.

9. Access

We never ask for your passwords. You give us access through the roles your platforms provide, and you can remove it at any time.

10. Territory

One client per business category per metro area on the Local, Growth and Authority plans. A metro area is a U.S. Census core-based statistical area. For a law firm, each practice area counts as its own business category. A law firm holds only the practice area its plan covers at each location, named in writing when the work starts; a second practice area takes a plan of its own.

11. What we do not promise

We do not guarantee rankings, traffic, calls or sales. Search engines and AI assistants are run by other companies and change without notice. Anyone who promises a number one position is guessing.

12. Your part

Give us accurate information about your business, and only send material you have the right to use. You approve any claim about medical, legal or financial matters before it is published. If we manage paid ads for you, the ad spend is paid by you directly to the ad platform, and you approve every budget change.

13. Limit of liability

To the extent the law allows, our total liability for any claim is limited to the fees you paid us in the 3 months before the claim, and we are not liable for indirect or consequential losses such as lost profits. Nothing here limits liability that cannot legally be limited.

14. Changes to these terms

If we change these terms in a way that matters, we email active clients at least 14 days before the change takes effect and update the date at the top of this page.

15. Governing law

These terms are governed by the laws of the State of New Hampshire.
